Overview Fanatics Live permits approved Sellers to run promotional giveaways, sweepstakes, and contests on the platform. From time to time, Fanatics Live may also conduct its own promotional activities. Sellers may conduct promotions at their own discretion, provided they comply with: * This Seller Giveaway Policy, * Our [Terms of Use](https://support.fanatics.live/article/terms-of-use-S14XNhkvZe) , and * All applicable federal, state, and local laws. Promotions may not be conducted where prohibited by law. Fanatics Live does not review, pre-approve, endorse, or administer individual Seller promotions. Each Seller is solely responsible for the operation, administration, and legal compliance of its promotions. Fanatics Live is not the sponsor of any Seller giveaway and assumes no responsibility for Seller promotions. If Fanatics Live conducts its own promotion, it will be clearly identified as the sponsor. This Policy is intended to provide general guidance regarding permitted promotions and minimum requirements. It is not legal advice. Sellers are solely responsible for understanding and complying with applicable laws in every jurisdiction where they offer a promotion. Sellers should consult their own legal counsel with questions about compliance. By running or participating in a Seller promotion, you agree to follow this Policy. ## 2\. Permitted and Prohibited Promotions ### A. Permitted Promotions #### 1\. Giveaway For purposes of this Policy, a Giveaway refers to a promotion where winners are selected at random and no purchase, payment, or other consideration is required to enter or win. To the extent permitted by applicable law, Sellers may require participants to complete free engagement actions as a condition of entry, which may include: * Being present and watching a livestream while the giveaway is conducted; * Commenting in a chat during a livestream; * Liking or following a Seller social media account; or * Sharing or reposting content. Sellers may not require any of the following as a condition of entry into a giveaway: * The purchase of any product or service; * The payment of any fee; * The payment of shipping or handling as a condition of a giveaway prize redemption; or * Paid subscriptions or paid access. #### 2\. Sweepstakes For purposes of this Policy, a Sweepstakes refers to a promotion where winners are selected at random and entries may be offered in connection with a purchase, provided that: * A free and clearly disclosed Alternative Method of Entry (AMOE) is available; * AMOE entries are treated with equal dignity as entries obtained in connection with a purchase; * The AMOE provides an equal opportunity to win; and * A purchase does not increase the odds or chances of winning. If a free AMOE is not provided, the promotion is prohibited. #### 3\. Contest For purposes of this Policy, a Contest refers to a promotion where winners are selected based on skill or clearly defined judging criteria rather than chance. Judging criteria must be objective and disclosed in advance. ### B. Prohibited Promotions #### 1\. Lottery For purposes of this Policy, a Lottery refers to a promotion that includes all three of the following: * A prize; * Chance; and * Required purchase, payment, or other consideration. Lotteries are illegal in most jurisdictions and are strictly prohibited on Fanatics Live. #### 2\. Misleading or Deceptive Promotions Sellers may not engage in any misleading or deceptive conduct, which includes but is not limited to: * Suggesting that a purchase increases the odds of winning; * Misrepresenting prize value or odds; * Implying that someone has already won when they have not; * Manipulating winner selection; or * Engaging in any other deceptive or unfair practices as defined by applicable law or as determined by Fanatics in its sole discretion. ## 3\. No Purchase Necessary and Alternative Method of Entry (AMOE) ### A. No Purchase Necessary For any promotion where winners are selected at random, entry must not require a purchase or payment. A purchase must not: * Be required to enter; * Improve the odds of winning; or * Be implied as necessary to participate. All official rules and disclosures related to a giveaway or sweepstakes must clearly and conspicuously state: > "NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.  FANATICS LIVE IS NOT A SPONSOR, OR RESPONSIBLE FOR ANY ASPECT, OF THIS PROMOTION.  BY ENTERING INTO THIS PROMOTION, YOU AGREE TO RELEASE FANATICS LIVE FROM ANY AND ALL LIABILITY ARISING OUT OF OR RELATED IN ANY WAY TO YOUR PARTICIPATION IN THIS PROMOTION." (NPN/Release Disclosures) ### B. Alternative Method of Entry (AMOE) If entries are offered in connection with a purchase or paid participation, the Seller must provide a free and clearly disclosed AMOE. AMOE entries must be treated with equal dignity as entries obtained in connection with a purchase.  The AMOE must: * Be available during the same entry period; * Provide an equal opportunity to win; * Not be materially more difficult than the purchase entry method; and * Be clearly described in all promotion rules and disclosures. If a compliant AMOE is not provided, the promotion is prohibited. ### C. No Fees to Receive a Prize Winners may not be charged any fee to receive a prize, other than applicable taxes. Prize delivery may not be conditioned on undisclosed payments. ## 4\. Official Rules and Disclosure Requirements Sellers must create and maintain written official rules for each promotion. At a minimum, official rules must clearly and conspicuously disclose: * The NPN/Release Disclosures; * Eligibility requirements (e.g., age, location); * Entry methods, including any free AMOE; * Start and end dates of the promotion; * Description and approximate value of all prizes; * Odds of winning or a statement that the odds of winning will depend on the overall number of entrants; * Description of how winners are selected and verified by the Seller; * Prize fulfillment/redemption requirements, if applicable; * Sponsor (the Seller conducting the promotion) identity and contact information; and * Any other information required by applicable laws or regulations in the jurisdiction(s) in which the promotion is offered. Official rules must be made easily accessible to participants without requiring any purchase or payment. By entering the giveaway, collectors agree to the seller's applicable rules. Sellers are responsible for ensuring that acceptance of these rules is a condition of entry. Sellers must provide access to these rules via a clearly visible link or method prior to participants entering a promotion. ## 5\. Enforcement and Platform Rights Fanatics Live reserves the right, in its sole discretion, to review, restrict, remove, or disable any promotion that does not comply with this Policy, the Terms of Use, or applicable law. Fanatics Live may take enforcement action, including but not limited to: * Removing or canceling a promotion; * Disqualifying participants; * Withholding or voiding prizes; and/or * Suspending or terminating Seller accounts for repeated or serious violations. Fanatics Live also reserves the right to disqualify or void promotional entries or prizes if we reasonably suspect abuse, fraud, or manipulation of the promotion, including but not limited to: * Creating or using multiple accounts to gain an unfair advantage; * Use of bots, scripts, or automated participation; or * Not being present in the livestream or required environment at the time of the giveaway. In such cases, any associated promotional entries or prizes may be forfeited at Fanatics Live's discretion.
